This privacy policy (this “Policy”) explains how your personal information is collected, used, and disclosed by Rocicorp LLC (“Rocicorp” or “we”). This Policy applies to users who use our tools for software developers, including Replicache, a data synchronization system (“Software”) and users of our services, some of which are provided to you via our websites, located at https://roci.dev, https://rocicorp.dev, https://replicache.dev (the “Websites”) . Such Software and related services, including any updated or new features, functionality and technology are collectively referred to as the “Service” or “Services”.
Other third parties, such as the third-party payment services integrated into the Websites, may also collect, use, and share information about you. This Policy does not cover such third parties or their services. For information about third-party privacy practices, please consult with them directly.
If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using these Services, you agree to this privacy policy. We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on this Policy the date it was last updated. We encourage you to review this Policy from time-to-time to make sure that you understand how any personal information you provide to us or collected about you will be used.
Information We Collect
We collect information from you and other users of our Services as described in this Policy.
Active Collection of Your Data
We collect information from you when you use the Services. For example, we may ask you to provide contact information such as your name, email address, and other personal master data, communication data, and data to render an account for the Services performed. You can choose not to provide certain personal information but, if you choose to do so, you might not be able to take advantage of the Service.
We may collect financial information, such as your payment method (valid credit card number, type, expiration date or other financial information) through a third-party payment process provider (the “Payment Processor”) in which case the information is collected and stored by the Payment Processor, and use and storage of that information is governed by the Payment Processor's applicable terms of service and privacy policy.
Passive Collection
When you use the Service, we may collect and use through features of our Software certain usage information of any user, including your end users' usage information, related to the use of the Software. Such collected information may include information on the device, the software and platform version used, and a unique id per browser profile instance that we generate for our own use to identify how frequently the Software is used.
We may also automatically collect certain information through the use of “cookies” and other HTTP headers and connection information, which may contain technical information, and in some cases personal information, such as IP address, browser type and operating system, referring URLs, your use of our Websites, and other data. Cookies are small data files stored on your hard drive at the request of a website. Among other things, cookies help us to improve the Service and your experience. If you wish to block, erase, or be warned of cookies, please refer to your browser manufacturer to learn about these functions. However, if you choose to remove or reject cookies, this could affect certain features or services made available on the Websites.
We may use web beacons or similar technology on the Websites. Web beacons are small, invisible graphic images that may be used on the Websites to collect certain information and monitor user activity, such as to count visits and understand usage effectiveness.
We currently do not employ technology that recognizes “do-not-track” signals. We may engage third parties, such as marketing or analytics partners, who may collect information about your online activities over time and across different websites when you use our Websites.
Information We Collect
We use personal information collected through our Websites and the Software for the following purposes:
- to process and complete transactions in connection with the Services (e.g. to enable you to purchase licenses to our Software via our Websites);
- to request feedback and to otherwise contact you about your use of the Service;
- to respond to your emails, questions, comments, requests and complaints, and to provide customer service;
- to analyze your and your end users' use of the Services, features and functionality of the Services, and your and your end users' Software license;
- to facilitate the provision of software updates and product support related to the Services;
- to monitor and analyze Website and Software usage and trends;
- to send you confirmations, updates, security alerts and support and administrative messages, and otherwise facilitate your use of, and our administration and operation of, the Services;
- to notify you about important changes to the Service;
- to provide, evaluate and improve the Service;
- to keep the Services safe and to investigate, prevent, or take action regarding unlawful or harmful activities, including potential violations of our terms of service;
- with information, news and offers on our products and/or Services which you may opt-out of at any time; and
- for any other purpose for which the information was collected.
We will ensure that your personal data is processed lawfully, fairly, and transparently, without adversely affecting your rights. Wherever applicable law requires, we will only process your personal data if at least one of the following applies:
- you have given express or implied consent to the processing of your personal data for one or more specific purposes;
- processing is necessary for the performance of a contract to which you are a party or in order to take steps at the request of you prior to entering into a contract;
- processing is necessary for compliance with a legal obligation to which we are subject;
- processing is necessary to protect the vital interests of you or of another natural person;
- processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority; and/or
- processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, except where such interests are overridden by the fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
Privacy Laws
We shall comply with all applicable rules and regulations regarding data protection in connection with the described use of personal data, i.e. the California Consumer Privacy Act of 2018 or the European General Data Protection Regulation (EU) 2016/679 (the “GDPR”).
Storage Of Information
Personal data will be stored using industry standard security measures on secured servers and we may store and process personal information in the United States and other countries. You are deemed to accept and agree to this by using our Services and submitting information to us. We will take reasonable steps to ensure that your data is treated safely and securely.
Data Retention
We only keep your data for as long as we need to in order to use it as described above, and/or for as long as we have your permission to keep it.
We may, however, retain personal information for an additional period in the form of a routine backup or as is required under applicable law or regulations, for prudent tax and accounting purposes consistent with good business practice, or for legal reasons, including as necessary to resolve disputes and enforce our agreements.
Security Of Your Personal Information
We take reasonable measures to protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can guarantee against any interception or any other type of misuse.
Your Information Choices And Changes
In the event we decide to use your personal information for any purpose other than as stated in this Policy, we will offer you an effective way to opt out of the use of your personal information for those other purposes. You may opt out of receiving promotional emails from Rocicorp by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as emails about your Rocicorp account or our ongoing business relations.
How We Share Information
We do not share your personal information with third parties other than as described as follows:
We may share personal information with affiliates, third-party vendors, consultants, contractors and other service providers who work for us. Such third-party vendors may include vendors who provide to us software development services, third-party payment services, cloud hosting services, off-site backups, or email services.
We may disclose your personal information (i) to comply with laws and to respond to lawful requests and legal process, (ii) to protect the rights and property of Rocicorp, our agents and customers, and others, including to enforce our agreements, policies, licenses and terms of service, and (iii) in an emergency to protect the personal safety of you, Rocicorp customers, or any other person.
We may share aggregate statistical data for the improvement of our Services.
We will only share your personal information with third parties to the extent necessary to perform their functions, in accordance with the purposes set out in this Policy and applicable laws.

Any personal information you provide on the linked pages is provided directly to that third- party and is subject to that third-party's privacy policy. This Policy does not apply to such linked websites, and we are not responsible for the content or privacy and security practices and policies of these websites or any other websites that are linked to/from such sites.
